George Kornec and Phil Nappo of the White Hope Mine in Lincoln, MT, are in an incredible battle with the United States of America. There are several intricate pieces to this puzzle, all revolving around one MAJOR detail. The USFS is claiming that these men defaulted in payment and therefore abandoned their claim.
In the counter claim from George and Phil's attorney's, Fred Kelly Grant and Josh Campbell, it states that all fees have been paid and that the mines are in good standing with the BLM. In essence, these men never defaulted in payment and have not ,in fact, abandoned their claims.
In the United States answer to the counter claim on October 14, 2015, the BLM admits that indeed George and Phil do pay a yearly assessment fee and that "THE FEES ARE CURRENT"!
So, why are we in this battle then? Excellent question!
